Islington Council has secured a hugely important legal victory that will help deliver more new genuinely affordable homes for local people, including at the former Holloway Prison site. 

The Islington Labour-run Council has been opposing a development, alongside the local community in St George’s ward, at the former Territorial Army site on Parkhurst Road since 2013, as the plans did not include enough genuinely affordable housing.

Despite planning permission being refused twice, the developer appealed and two lengthy public inquiries were held – both of which were won by Islington Council. The developer then tried to mount a legal challenge in the High Court against the independent Planning Inspectorate’s decision to support the Council’s decision.

On Friday 27th April, the High Court legal challenge was dismissed and the the decision to refuse the planning permission was upheld.

This legal victory not only means that the developer must deliver more genuinely affordable homes than they had planned to – it also has a huge impact on the future of Holloway Prison.

The legal decision backs Islington Council’s position that developers must follow the Council’s planning guidelines and should not overpay for land in an attempt to bypass genuinely affordable housing requirements through the viability process.

Cllr Satnam Gill, St George’s ward councillor, said: “It’s great news that the High Court has upheld the Council’s decision. This will help us to deliver more genuinely affordable housing in St George’s ward and across Islington.

“We’ve been working on this campaign with local people for many years and now want to push for the genuinely affordable homes our community needs to be delivered at Parkhurst Road and at Holloway Prison.”
